Builders win important vested rights case
   The Court of Appeals has ruled in Westside Business Park, LLC v. Pierce County that a local government cannot apply new, more restrictive storm water drainage standards to plats filed before the new standards take effect. Significantly, the first Court of Appeals ruling was unpublished, meaning that it could not be cited as legal authority in future cases.

Realizing the importance of this ruling to builders across the state, the Building Industry Association of Washington (BIAW), pursued a rarely used court procedure by filing a motion to publish the opinion. The Court of Appeals granted it and now the case is legal authority, creating a legal precedent for the benefit of all builders statewide.
