You might recall when the so called “Fairness Act” first surfaced as a response to radio commentators on KVI who expressed their views on I-912. Democrats overwhelmingly disagreed with I-912, (You see, democrats don’t like it when the public actually gets to vote on whether their taxes are raised). So, they made a fuss about KVI commentators using air time to support I-912 and said that all such air time should be reported as an in-kind donation to the I-912 campaign.

Aside from being utterly ridiculous and unfair in nature, the Fairness Act was not applied across the board. Please notice that the only hosts targeted by the Fairness Act were Kirby Wilbur and John Carlson of KVI, both conservative. What about in 2004, when Dave Ross stayed on KIRO radio for a couple of weeks after announcing his candidacy for U.S. Congress against Dave Reichert? After he finally went off the air, the station continued to call the show, “The Dave Ross Show”. I’m sorry, but I’m going to need to see the FEC reports from that 2004 election to make sure all air time referring to Dave Ross was reported as an in-kind donation to the Ross campaign. Let’s see how the democrats feel about the fairness act when it’s actually applied fairly!

Fortunately, we’ll never have to see. As luck would have it, the Washington State Supreme Court believes in free speech and the Fairness Act was struck down 9-0.
