DOL issues report on FMLA comments,
but no fix is on the horizon
Just a few months after initially requesting comments on the Family and Medical Leave Act (FMLA) the Labor Department released a lengthy analysis of the comments highlighting areas of conflict over the law.

There were more than 15,000 comments submitted by advocates and critics of the federal leave law. The report does not, however, make any proposed regulatory changes.

The Labor Department acknowledged that advocates on all sides of the debate over the FMLA were anticipating proposed regulations after the information request, but that the goal in releasing the report was to provide a basis for further discussion.

The report focused on nine broad areas relating to the FMLA, as well as a section detailing statistical and quantitative analysis relating to the impact of the FMLA.

Some of the broad areas of concern include:

  • Unscheduled intermittent leave
  • Notice
  • Medical certification
  • The interplay between the FMLA and the Americans with Disability Act
  • Defining a serious health condition
