Employers winning most disability cases |
Employers are winning more than 9 out of 10 employment disability cases decided in federal court, according to a survey conducted by the American Bar Associations Commission for Mental and Physical Disability Law. Of the 291 wins credited to employers in 1999, 257 were on summary judgment motions, while 34 were on the merits. The survey data does not measure cases that settled prior to adjudication.
The difficulty with establishing the presence of a disability is among the factors that has contributed to employer success in defending ADA cases. |
